Private Dining Room Bookings Terms & Conditions
The Terms and Conditions (the “Terms”) set out below apply to your booking and form part of the contract between you and Nanyang Blossom (the “Restaurant”).
1. Confirmation of Booking
1.1 Bookings will be considered confirmed only upon the Restaurant’s receipt of the following:
• A signed copy of the Terms.
• A signed Credit Card Guarantee form.
• A deposit (if applicable).
1.2 Any changes to booking details must be submitted in writing and will have no effect unless acknowledged in writing by the Restaurant.
1.3 If the Terms are signed on behalf of a company, partnership, agency, firm, club, or similar organization, the signatory represents to the Restaurant that they have full authority to execute the Terms. If not authorized, the signatory will be personally liable for the complete performance of the contract with the Restaurant.
2. Financial Commitments, Deposits, and Payment Settlement
2.1 The agreed minimum expenditure for this reservation is established at the time of booking and includes VAT at the current rate. A discretionary service charge of 15% is not included in this amount.
2.2 A deposit is required immediately after agreeing to the Terms to confirm the reservation.
2.3 The Restaurant mandates that the deposit and any additional agreed payments be received as cleared funds at the time of booking to finalize the reservation.
2.4 The total bill is due on the day of the reservation. Your deposit will be subtracted from the total bill at this time. As no credit facilities are offered, failure to pay the full amount on the day of the reservation will authorize the Restaurant to charge the remaining balance to the credit/debit card provided in the Credit Card Guarantee form.
2.5 Should any part of the bill remain unpaid, interest on the overdue amount will accrue daily at a rate of 2% per month, calculated from the payment due date until full settlement.
2.6 All billing inquiries or disputes must be formally submitted within 5 business days following the bill’s issue date.
3. Deposit Default
3.1 Should you not provide the required deposit as cleared funds, the Restaurant reserves the right to cancel the reservation without any obligation to you and may charge you for any expenses it has incurred related to the booking.
4. Your Cancellation Rights
4.1 To cancel a reservation, you must send a written notice to the Restaurant. A cancellation will only be effective if the Restaurant confirms it in writing.
4.2 The Restaurant agrees to refund deposits for cancellations notified at least 4 days before the scheduled reservation.
4.3 Cancellation made at least 7 days before the scheduled reservation, the restaurant will provide a 100% refund of the deposit.
4.4 Cancellation made at least 96 hours (4 days) before, the restaurant will provide a 50% refund of the deposit.
4.5 Cancellations made within 96 hours (4 days) of the reservation will not be eligible for a refund.
5. Reservation Cancellation by the Restaurant
5.1 The Restaurant reserves the right to cancel a reservation without any liability under the following conditions:
• (i) Closure of the Restaurant due to unforeseeable events beyond its control, such as fires, mechanical failures, staff disputes, or directives from public authorities.
• (ii) Occurrence of Force Majeure events, detailed in clause 14 of these Terms.
• (iii) Your insolvency or commencement of liquidation/receivership proceedings.
• (iv) Any breach of the Terms by you.
• (v) Non-payment or failure of the deposit to clear as stipulated in these Terms.
6. Payment Guarantee via Credit/Debit Card
6.1 A credit/debit card is necessary to guarantee your reservation. As specified in clause 2.3, the Restaurant may charge the provided credit/debit card for any unpaid portion of the final bill on the reservation date.
7. Confirmation of Attendance
7.1 The final count of guests for the reservation must be confirmed in writing no later than 4 days before the reservation date.
7.2 If the number of guests decreases and the Restaurant is not informed at least 3 business days before the reservation date, as required by clause 7.1, you will be charged for the original number of guests booked. This charge will reflect the selected menu’s price and the number of guests who did not attend.
7.3 The Restaurant will attempt to accommodate any increase in the number of guests and will apply charges for this service as necessary. However, the Restaurant is not liable if it cannot provide accommodation or service for additional guests.
8. Menu Selection and Dietary Accommodations
8.1 The Restaurant requires a uniform menu selection for all guests but will cater to individual dietary needs upon request.
8.2 Please inform the Restaurant of any dietary restrictions when choosing your menu.
8.3 Menu and wine selections must be finalized and communicated to the Restaurant no less than 7 days before the reservation. Should any item be unavailable due to supply issues, the Restaurant will promptly offer a suitable alternative.
9. Pricing Details
9.1 The listed prices incorporate the current VAT but do not include the optional 15% service charge.
9.2 Prices are accurate as of the latest publication and encompass VAT and any applicable government taxes.
9.3 The Restaurant may adjust prices to reflect any alterations in VAT rates or other tax changes.
10. Allergy and Intolerance Advisory
10.1 Guests must inform the Restaurant of any allergies or intolerances in line with clause 8. Before ordering extra items, please ensure a staff member is aware of these dietary restrictions.
10.2 While the Restaurant takes every precaution, guests with severe allergies should note that there is still a potential risk of exposure to allergens. Custom orders are made with care but cannot be certified as completely free from allergens and are consumed at the guest’s discretion.
11. Conduct of Guests
11.1 Guests are expected to maintain orderly behaviour during the event. It is your responsibility to ensure that all activities comply with the law and do not cause disturbance, violate any licenses, or lead to forfeiture of such licenses. This includes preventing illegal activities such as drug use, gambling, or unauthorized betting.
11.2 The Restaurant has the authority to deny entry or remove any guest deemed to be behaving inappropriately, at its sole discretion.
12. Dress Code
12.1 The dress code is smart casual. Sportswear, tracksuits, and jogging bottoms of any style or brand are not permitted. Flip flops are also prohibited, but neat trainers are acceptable.
12.2 The Restaurant has the full authority to deny entry to any guest who does not adhere to the dress code.
13. Personal Belongings
The Restaurant is not responsible for the loss or damage of personal items belonging to you or your guests on its premises.
14. Force Majeure
Neither party will be held in breach of their contractual obligations if hindered by events beyond their control, such as wars, strikes, riots, natural disasters, government actions, or power outages.
15. Use of Restaurant’s Intellectual Property
15.1 The Restaurant’s logos and intellectual property may not be used without obtaining prior written permission from the Restaurant.
15.2 If permission is granted, your use of the Restaurant’s logos and intellectual property is restricted solely to the event or meal in question. All promotional materials created for this purpose must receive the Restaurant’s approval before use. Any materials featuring the Restaurant’s logos or intellectual property that have not been approved must be destroyed immediately
16. Engagement of Third-Party Services
16.1 Should you desire to hire external services such as a photographer, toastmaster, musicians, or others for the event, prior notification and approval from the Restaurant are required.
16.2 Upon receiving the Restaurant’s approval, you are responsible for fully informing Nanyang Blossom of all related details. Additionally, you must ensure that the third-party service provider carries sufficient insurance and complies with all health and safety regulations.
17. Liability Limitations
17.1 The liabilities for death or personal injury due to negligence, fraud, or misrepresentation are not restricted by these Terms for you, your guests, or the Restaurant.
17.2 You and your guests acknowledge responsibility for any damage to the Restaurant or its property resulting from any negligent or wrongful act and agree to provide compensation for such damages.
18. Confidentiality Agreement
18.1 Both parties, you and the Restaurant, commit to:
• (i) Maintain the confidentiality of information.
• (ii) Refrain from using the information for personal purposes.
• (iii) Not disclose any confidential information to third parties without written consent from the other party. This includes the Terms and the selected menu, except when such information becomes publicly known through no fault of either party.
19. Governing Law
The Terms, along with any related non-contractual obligations, are subject to the laws of England and Wales. The courts of England and Wales will have sole jurisdiction over any disputes.
